Across the United States, legislators are rethinking the use of psychedelics for personal and therapeutic use.
Currently, the only psychedelic substances which can be prescribed by New York mental health care providers are ketamine (for off-label use) and Spravato (which only includes the esketamine molecule). Our firm is ready to assist New York providers with respect to starting or running a ketamine clinic or to advise regarding other aspects of ketamine treatment.
There are several bills pending in New York State which would legalize psychedelics for personal use and/or for use by New York mental health providers during treatment (as has already occurred in Oregon and Colorado). If and when other psychedelics are legalized in New York, our firm will be able to represent providers with respect to using these substances under whatever legal framework might be formed in New York. Furthermore, we can consult with New York providers regarding what legal limitations or risks they may be up against on the federal level, even if such substances are legalized in New York. Please contact Shea Fitzekam, Esq. with any questions regarding psychedelics law.
