Shea E. Fitzekam

A partner with the firm, Shea practices primarily in the areas of Health Law, Business and Commerical Law, and Contracts.

She graduated magna cum laude in 2000 from the University of Nebraska at Lincoln. In 2003, she received her J.D. from Syracuse Univeristy College of Law. She is a member of the American Health Lawyers Association. Shea is admitted to practice law in New York and Nebraska.

Professional Background and Experience

Shea Fitzekam’s main practice area is health law.  Her work in health law includes, but is not limited to:

– advising health care industry clients about  health law regulations and compliance, such as the Stark Law, the Anti-Kickback Law, the Anti-Markup Rule, Medicare billing and New York’s prohibition on the corporate practice of medicine and fee splitting;

– defending medical practices and physicians with respect to private payor audits, including allegations of overpayment and recoupment efforts by private payors;

– general representation of medical groups, which includes preparing operating agreements and shareholder agreements, preparing employment agreements for physicians in such groups, membership interest purchase agreements, share purchase agreements, professional services agreements, resources agreements with management and administrative services entities, asset purchase agreements, leases of space and/or equipment with hospitals; enforcement of non-competition agreements and negotiations of contracts with private payors; and

– representation of individual physicians regarding disputes with their employers, negotiation of physicians’ withdrawal as shareholders or members from their medical groups or ambulatory surgery centers, representing physicians with respect to employment agreements with new employers and renegotiating their employment agreements with their current employer.

Shea also represents individuals seeking coverage for certain health care services by their health insurance companies.
