Shea E. Fitzekam

A partner with the firm, Shea practices primarily in the areas of Health Law and Transactional Law, with an interest in the emerging space of Psychedelics Law.

She graduated magna cum laude in 2000 from the University of Nebraska at Lincoln. In 2003, she received her J.D. from Syracuse Univeristy College of Law. Shea is admitted to practice law in New York and Nebraska.

Professional Background and Experience

With over 11 years of experience as a health law attorney at Daniels, Porco and Lusardi, LLP, Shea has developed a comprehensive and in-depth knowledge of the legal issues affecting the health care industry. Shea’s main practice area is health law, and she provides effective and strategic advice and representation to a wide range of clients, including medical groups, physicians, hospitals, ambulatory surgery centers and other facilities. Her interest lies in the emerging space of psychedelics law. Various bills are pending in the New York Assembly which would legalize psychedelics for mental health treatment. In the event these New York bills are signed into law, Shea is excited to assist New York providers in developing legally compliant psychedelics therapy programs.

Shea counsels her clients with respect to health law regulations and compliance, such as the Stark Law, the Anti-Kickback Law, the Anti-Markup Rule, Medicare billing, and New York’s prohibition on the corporate practice of medicine and fee splitting.  She assists her clients with general and transactional aspects of health law, such as preparing and negotiating operating agreements, shareholder agreements, employment agreements, purchase agreements, professional services agreements, leases, and contracts with private payors. She has extensive experience in advising and representing individual physicians with respect to their employment rights, obligations, and opportunities, as well as their withdrawal and transition from their medical groups or ambulatory surgery centers. Her goal is to help my clients achieve their professional and personal objectives while protecting their interests and minimizing their risks. Shea is a founding member of the Psychedelic Bar Association and is a member of the New York City Bar Association’s Drugs & the Law Committee and its Psychedelics Law Subcommittee.
