She graduated magna cum laude in 2000 from the University of Nebraska at Lincoln. In 2003, she received her J.D. from Syracuse University College of Law. Shea is admitted to practice law in New York.
Professional Background and Experience
With over a decade of experience as a health law attorney at Daniels, Porco and Lusardi, LLP, Shea has developed a comprehensive and in-depth knowledge of the legal issues affecting the health care industry.
Shea counsels her clients with respect to health law regulations and compliance, such as the Stark Law, the Anti-Kickback Law, the Anti-Markup Rule, Medicare billing, and New York’s prohibition on the corporate practice of medicine and fee splitting. She assists her clients with general and transactional aspects of health law, such as preparing and negotiating operating agreements, shareholder agreements, employment agreements, asset purchase agreements, professional services agreements, leases, contracts with private payors, and administrative services agreements. She has extensive experience in advising and representing individual physicians when joining new medical groups and also during their withdrawal from medical groups. She also has extensive experience structuring arrangements between medical groups and administrative services organizations (sometimes referred to in New York as “MSOs”).
Shea also has an interest in the emerging space of Psychedelics Law. She advocates for a wide range of legalized treatment options for those suffering from mental health conditions. Currently, New York healthcare providers are only able to provide mental health treatment to their patients using ketamine. However, legalization in New York of certain psychedelics for mental health treatment may be on the horizon. In this event, New York providers will need an experienced health law attorney to navigate them through the complexities of implementing psychedelic treatment programs.
